The US Justice Department has entered the fray in a lawsuit initiated by California Republicans, aiming to halt the California's recently passed electoral boundaries.
This court case, submitted to a US district court, challenges the map championed by Governor Gavin Newsom, which was created in reaction against a Republican-led gerrymander in Texas.
"The state's electoral map represents a brazen power grab that tramples on voting rights and mocks the democratic process," declared the US attorney general.
Democrats have expressed confidence that the redistricting plan will survive legal scrutiny.
"These opponents lost at the ballot box and they are likely to also lose in court," stated a spokesperson for Governor Newsom.
Legal Basis
The lawsuit asserts that California's map wrongfully utilized race as a factor to significantly advantage Latino communities in violation of the federal constitution.
"It is unconstitutional to use race as a substitute to advance political interests, but that is exactly what the state legislature did with the redistricting measure," argued a high-ranking representative from the Civil Rights Division.
Political Context
The legal battle represents the major response by Democrats in the ongoing political battle that started with Texas and has spread across multiple states.
Unlike other states, where Republican state legislatures have enacted gerrymanders, California's plan needed voter approval, which it obtained with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to flip just a small number of Republican-held House seats to gain majority of the chamber in next year's congressional elections.
The political group controlling the controlling share will shape the final years of the sitting president's term, determining whether a GOP-controlled legislature will persist in implementing its political program or face resistance, congressional probes and potential additional obstacles.
